Human nature is to be corrupted by power - this includes those that hold power, those that seek power and those that help those that hold and seek power.
Personally, I find the entire tone and style of our current and past federal election distasteful and insulting. I had always been aware of how absolute power corrupts absolutely, especially in Ottawa, Canada these days.
In Canada we have no people created and contracted constitution and our immutable, inherent sovereign rights stem solely from the "Magna Carta" of June 15th 1215, and as updated 1216, 1217, 1225, and 1264 and the evolution of common law and statue law that resulted from the "Magna Carta".
The "Magna Carta", some 790 years ago, was the symbol and rallying point for "FREEMEN" of that era to struggle to attempt to defend their immutable, inherent rights and freedoms against the "GANGS" of that era. Ironically, today�s version of some of those "GANGS" of 1215 still exists today.
The "Magna Carta" was for all "FREEMEN", regardless of wealth or social status, and was intended to set up guarantees that all "FREEMEN" would not have their liberties threatened. It created one of the first "Codifications" of our rights and placed limits not only on the "Ruler�s Rights", but also on the conduct of all of the Kings and Baron�s staff as well. This enormous step for mankind created "Common Law" and the first steps towards a Rule of Law society and the concept of sovereignty being with the people.
The "Magna Carta" was also one of the foundations for the emergence of early "Statute Law", which evolved gradually when in 1297 the Magna Carta was enrolled by Edward I into his statute rolls. This started the parallel and complimentary development of our Westminster style "RULE OF LAW" governed democratic society. This gradual evolution changed the "Magna Carta" from a contract to protect our rights and liberties into a source of universal basic legal principles that our society and many other democratic societies operate within over the next 790 years in many parts of the globe. These Common and Statute Laws were designed to limit the ability of the Rulers [Executive branch], Magistrates [judicial branch], Elected officials [Congress/Parliament and Senate, as well as local and regional governments], Military and police, other civil Servants, Artificial Persons [including governments, societies and corporations] to unilaterally abuse their positions of power and influence.
Significant developments with the evolution of statute law occurred in 1628 with the Petition of Right, 1628 and in 1679 with the Habeas Corpus Act, 1679, and in 1689 with the passage of the Bill of Rights, 1689 . The immigration to North America from England also exported this evolving Common and Statute Rule of Law system. Ironically, the dispute with England that lead to the creation of the Republic of the United States was about ensuring that the all citizens of the new country, rich and poor would have their "FREEMEN" rights and liberties protected in a truly free and democratic society.
The US revolution lead to a new and innovative development - a people generated constitutional contract. A representative system was created to specifically create a constitutional contract that would balance the 7 key centers of power that must remain within the strict limitations of trust and respect over hundreds of years against attacks from inside and outside. These 7 elements are: [1] The Executive branch, [2] the Judicial branch, [3] the Congress / Parliament, [4] the Senate, [5] the Military and Police, [6] the Regional and Local governments, and [7] All of the staff and leaders involved in items [1] to [6].
The Magna Carta is a charter of liberties guaranteed by a King to his subjects whereas the Constitution of the United States is a "Contract" between the citizens and governments to attempt to establish a true democracy ruled by the people for the people [human beings].
In Canada we have never had a grassroots created, constitutional contract that ensured human beings were the dominant sovereign entity in Canada.
Canada has always been a patriarch feudal society, ruled from the top down. The Ruling elite and their gangs have systemically, over the decades, carefully constructed and maintained an elaborate "ILLUSION OF DEMOCRACY", using the ever expanding federal national socialism to destroy the sovereignty of human beings as the dominate power source in our society.
One of the most courageous efforts in our country�s modern history to bring people based democracy to Canada occurred when the then Conservative Prime Minister - the Hon. John Diefenbakker undertook his legacy initiative to protect "Human Beings / Persons" with the passage of his Canadian Bill of Rights, 1960, c.44.
It became one of the most significant pieces of federal legislation in our country�s history, which legally still dominates statute law today and is suppose to protect our enumerated rights, including specifically property rights.
It is also important to read the Statutory Instruments Act 1970-71-72, c.38, s. 1, and be aware of one of the most powerful federal committees in our federal government - the Joint Subcommittee Parliamentary and Senate Scrutiny of Regulations and their checklist for valid federal regulations.
In my last weeks viewpoint, I mentioned that the Canadian Charter of Rights and Freedoms, 1982 did not really give you and I anything we did not already have and that there was a very dark and sinister outcome of the Charter - a significant erosion of one of the fundamental building blocks of the Westminster style democracy - the destruction of the supremacy of Parliament to make laws and the very dangerous almost total transfer of "Supreme power" in Canada to our unelected, secretly hand-picked and unaccountable Supreme Court judges.
Stephen Harper was absolutely right in his statement last week about the Supreme Court Judges needing to be dealt with. It was sickening to see in the election rhetoric, Paul Martin, who I believe is one of the worst criminal gang�s front persons in Canada, acting in such an unprincipled, insulting and destructive way. I get very annoyed when, what I view as a wealthy elite gang front person such as Paul Martin insults not only my intelligence, but also my values, principles and beliefs and that of family�s by their negative propaganda attacks on people that have sincerely held beliefs that are different then Paul Martin�s and / or the gangs that influence him.
Fundamentally, in any truly democratic rule of law society, everyone should have the right to have "different viewpoints" and these differences should be our strength, not a wedge that gang front persons such as Paul Martin uses to divide and rule us for his gang�s selfish purposes.
WE HAVE TO WORK TOGETHER WITH MUTUAL RESPECT AND COURTESY AS A TEAM TO CREATE A TRULY DEMOCRATIC RULE OF LAW, CONSTITUTIONALLY BASE CANADA, WHERE NO ONE IS ABOVE THE LAW AND EVERYONE HAS THE ESSENTIAL NEEDS OF HUMAN BEINGS TO LIVE AND ACHIEVE OUR INDIVIDUAL AND COLLECTIVE DREAMS AND GOALS!
Respect, trust and confidence must be restored in our 7 key centers of power in order to address the increasing alienation, anger and frustration that millions of good and caring citizens of Canada are feeling.
We need to work together to create a new and innovative governing system that takes the best of the Swiss, US Republic and past British / Canadian Westminster style democracy and together, from the grassroots, develop a new model to not only return democracy to Canada, but also to provide a working model that can be adapted by other nations of the world in order to reduce war and terror and their underlying causes.
