Last week I wrote about it being a critical time in Canadian history and the fact that today, we are a nation in bondage in a "Modern Feudal Age". This has occurred very systemically as the federalists started using World War I as the excuse for polarizing power in Canada away from a "Federated State" as was so wisely designed in the Constitution Act, 1867 [also known as British North America Act, 1867] into a dictatorship with the "ILLUSION OF DEMOCRACY".
The Constitution Act, 1867 contained very specific division of jurisdictions between the federal and provincial levels of our government. Since day one federalists have been attempting to usurp provincial jurisdiction in areas such as food, health, civil and property rights.
It took almost 800 years for our British style Rule of Law, Constitutional Parliamentary democracy to evolve. It only took 20 years, starting with the Liberal government under Lester Pearson, for every safeguard of the "Freeman's rights" to be largely dismantled. Other "baby steps" taken earlier to disintegrate our democracy included: the Finanacial Act, 1914 [also known as Bank Act, 1914], the Temporary Income War Tax Act, 1917, the Adulteration of Food and Drugs Act, 1884 - now know as Food and Drugs Act. R.S., c. F-27, s. 1., the Department of National Health and Welfare Act, 1944, the Department of National Health and Welfare Act, 1945 amendment, the Medical Care Act, 1966, the Constitution, 1982 which includes the Canadian Charter of Rights and Freedoms and the Canada Health Act. 1984, c. 6, s. 1..
Our "Freeman" rights were premised on natural / human persons being the most important sovereign legal entity in society. These rights were first codified in Britain largely based upon Irish law concepts in 1215 in the "Great Charter" also known as the "Magna Carta".
The Magna Carta was the source of many of the most fundamental concepts of law that the Canada and American systems are based upon including the rights of due process, trial by jury, right to a speedy and unbiased trial, protection against excessive fines or imprisonment, protection against cruel and unusual treatment, no taxation without representation, none be denied or delayed, right and justice, and most important of all the right of a freeman not to be deprived of his inherent common law rights of life, liberty, or property except by a jury of his peers or by the law.
The Magna Carta, created over 800 years ago, is the foundation that our common law, Parliamentary and constitutional systems in Canada is still based upon. |
In North America there are over 100 actual legal cases that directly trace there decisions to elements that were expressly stated in the Magna Carta and its evolution of constitutional and common law rights.
Who would have believed that a document crafted in 1215 to control an out-of-control king and his staff would over time increasingly grow in relevance to the same type of abuses of power in 2006.
The Canadian Prime Minister today, has more personal power over our lives than any of the other G-8 leaders. Our Prime Minister and his staff of over 220 are now "above the law" as established by the Magna Charta and our almost 800 years of Rule of Law evolution. The Prime Ministers themselves, regardless of party, are potentially our king or dictator, however you want to describe it.
THERE IS NO LEGAL BASIS IN COMMON LAW, OUR CONSTITUTION, OUR BRITISH PARLIAMENTARY HISTORY OR TRADITION TO AUTHORIZE OUR PRIME MINISTER TO BE OUR RULER!
Ironically, under our Rule of Law and Constitutional authority, our legal "Head of State" which is the legal equivalent to the President of the USA is our Governor-in-General who is potentially liable both civilly and criminal for neglect of duty, breech of trust, and breech of statutory duty by carte blanche rubber stamping the unlawful and illegal actions of the Prime Minister and his staff.
Today as human / natural persons we need to each be protected from the arbitrary exercise of the powers of governments and other powerful "Barons" in our modern society such as the mega corporations and the ultra wealthy elite.
Ironically the usurping of power to federalist interests via the Prime Minister's office continued in Canada during and after the World War II. There were attempts by key leaders in the US, Britain and Canada to respect and protect the Magna Charta and the rights of Natural / Human persons against the growing power of "Artificial Persons" such as governments, publicly owned corporations and mega privately owned corporations.
In 1956 Winston Churchill said this about the Magna Carta: "here is a law which is above the King and which even he must not break. This reaffirmation of a supreme law and its expression in a general charter is the great work |
of the Magna Carta; and this alone justifies the respect in which men have held it".
The Magna Carta has become a symbol and a battle cry against oppression, exploitation, tyranny and injustice whenever evil schemers try to usurp power and abuse and violate the rights of freeman [natural / human persons] in a society.
The Magna Carta is generally viewed as consisting of a preamble and 63 clauses. It was more or less broken into nine sections dealing with the churches rights, rule of law pertaining to rights of owners of lands, rights of tenants, rights affecting towns, trade and merchants, reform of the rule of law, control of the behaviour of royal officials, royal property mainly focused on forests, peace and treaty issues and rules for trying to ensure that the king would honour the charter agreement.
In Canada the Magna Carta and the Constitution Act of 1867 provides the foundation for all "Freeman" also known as "Natural or Human Persons" to reclaim ourselves by learning about our immutable and inherent rights. You and I, as Human / Natural Persons, are sovereign beings with immutable rights that no government in Canada, Liberal of otherwise, can take away from us.
The 1982 Charter of Rights and Freedoms did not give you and I anything we did not already have, and that the Charter of Rights and Freedoms was not really a benefit to Human / Natural Persons and our immutable rights and interests.
IT IS CRITICAL THAT MILLIONS OF CANADIANS LEARN THE TRUTH ABOUT THESE MATTERS AND RETURN DEMOCRACY TO CANADA.
"That men who will not fight for liberty can lose it." A timely quote from President Franklin D. Roosevelt, April 13th 1943
