Departures from the Scheme by one Party in Exceptional Circumstances

2. A Party may make regulations in accordance with this Article only if satisfied that (a) it is necessary for it to do so having regard to exceptional public health, safety, third country trade, environmental or cultural factors that affect that Party;

The agency also defines what is and what isn't included -- in other words, all foods could be included as they have a physiological effect on the body...
