WHAT THE JUDGES WON’T TELL YOU: 2. If you choose not to avail yourself of this Right, but allow a Judge or Magistrate to judge the case, you must sign a Memorandum of Consent to that effect – otherwise, the Court has no Jurisdiction to proceed summarily. 3. If a Judge or Magistrate does not secure that signed Memorandum of Consent and does proceed summarily, that Judge or Magistrate is guilty of a felony which is punishable by five years imprisonment for each time they commit that offence. 4. No Parliament has the power to take away the Rights of the People. Should a Parliament reacherously make such laws, then those laws are no law, at all .... they are ultra vires. 5. In a Democracy, the People Rule by way of Referenda and Trials by Juries when Common Law is made. The People create Parliaments, which are obedient to the Will of the People. In a Democracy, Sovereignty, ie: the ultimate authority to make and impose laws, lies with the People. 6. The People create the Executive and the Executive appoint the Judges and Magistrates. Therefore, the Executive and the Judiciary are obedient to the Will of the People. 7. Common Law is the law of the People, by the People and for the People. Statute Law is Acts of Parliament. “Common Law doth control Acts of Parliament and adjudges them, when against common right, to be void”, ie: Common Law overrules Statute Law. In a Democracy, Juries have the power to judge the Justice of the law and nullify those laws, if they believe those laws are bad or inappropriately being applied to the case before them. 8. Trial by Jury is Trial by the People. Magna Carta says, “No free man shall be taken indeed imprisoned, either dispossessed, or outlawed, or exiled, or in any manner destroyed, nor pass over him, nor send over him, except by means of the legal judgment of his won equals indeed the law of the land.”. 9. Juries decide whether the parties to an action have done right or wrong and render Judgments which can either award damages or impose punishment. “Justice is the protection of rights and the punishment of wrongs”. No Judge or Magistrate can try or render Judgment in any action without the signed Memorandum of Consent from both parties to be without a Jury and allow the Court to proceed summarily. Words from “God Save the Queen” say, “May she defend our laws”. But the Queen has no intention of doing any such thing.
